Description of SMS program and messaging use cases

CDC Eagle Marketing, LLC (DBA Eagle One Marketing) operates an Application-to-Person (A2P) 10DLC SMS program. By opting in — for example, by checking the SMS consent box on our contact form and submitting your mobile phone number — you agree to receive text messages from us related to your booking inquiry and reservation activity.

• Program name: Eagle One Marketing Customer Notifications.
• Message types: Transactional and informational text messages, including booking inquiry follow-ups, availability and date updates, reservation confirmations, pre-travel reminders, and customer service communications.
• Message frequency: Varies based on your interaction with us. You may receive messages only when there is activity on your inquiry or reservation.
• Typical use cases: Confirming receipt of your inquiry, letting you know which requested dates are available, confirming a reservation, reminding you before your travel date, and answering customer service questions.

Instructions to opt out

You may cancel your participation in our SMS program at any time. To opt out, reply STOP to any text message you receive from us. Once we receive your STOP request, you will be unsubscribed and will no longer receive SMS messages from our program.

You may also request removal from the SMS list by emailing [email protected] or calling (954) 802-8826.

Opting out of SMS messages does not affect your ability to use our website, keep an existing reservation, or receive non-SMS communications from us.

Disclosures for message & data rates

Message and data rates may apply. Standard messaging rates charged by your wireless carrier will apply to all SMS messages sent to and from us. We do not charge a separate fee for sending or receiving text messages as part of our program. Contact your mobile service provider for details about your messaging plan and any applicable charges.

Consent is not a condition of purchase. Agreeing to receive SMS messages is not required to purchase any goods or services from us.

Carrier liability disclaimer

Our SMS program is supported on most major U.S. wireless carriers, including but not limited to AT&T, Verizon, T-Mobile, and UScellular. Message delivery is subject to your carrier's network availability and service terms.

Carriers are not liable for delayed or undelivered messages. We are not responsible for messages that are not received due to carrier network issues, device incompatibility, incorrect phone numbers, or changes to your phone number or carrier.

Age restriction

By opting in to our SMS program and using our website, you represent that you are at least 18 years of age. Our SMS program and website are not intended for use by individuals under 18, and we do not knowingly collect personal information from or send SMS messages to anyone under 18. Individual tour packages may carry a higher minimum age or other eligibility requirements, which will be disclosed to you before you pay.

We do not sell, rent, or share your mobile phone number or SMS opt-in information with third parties for marketing or promotional purposes.

Tour packages, bookings, and payments

Packages are marketed and sold by Eagle One Marketing as seller of record on behalf of independent resort and property partners. Eagle One Marketing does not own or operate the properties. Your stay is also subject to the property's own terms, policies, and check-in requirements.

• Availability. All packages are subject to availability. A reservation is not confirmed until we confirm it with the property and send you a written confirmation.
• Eligibility. Packages may carry eligibility requirements. Any requirements that apply to your package will be disclosed to you before you pay.
• Sales presentation. Certain packages require that you attend a scheduled presentation about vacation ownership during your stay. Where this applies, the requirement and its approximate duration will be disclosed to you before you pay and stated in your written confirmation.
• Deposits and holds. A deposit or refundable incidentals hold may be required to confirm a reservation. The amount, what it covers, and the conditions for release or refund will be disclosed before you pay.
• Changes and cancellations. Change and cancellation terms vary by package and property and will be provided with your written confirmation.
• Pricing. Quoted prices apply to the specific dates and occupancy discussed and may change if your dates, party size, or room type change. Taxes, resort fees, and incidentals may be additional and will be disclosed.

Information on this website is general and is not a binding offer. The terms stated in your written booking confirmation govern your reservation.

Disclaimer of warranties

The website and its content are provided "as is" without warranties of any kind, express or implied. We do not warrant that the site will be error-free, secure, or uninterrupted. Any warranties relating to a specific package or stay are described in the applicable booking confirmation or the property's own terms.

Limitation of liability

To the maximum extent permitted by law, CDC Eagle Marketing, LLC (DBA Eagle One Marketing) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the website, our services, or the SMS program.

Indemnification

You agree to indemnify and hold CDC Eagle Marketing, LLC (DBA Eagle One Marketing) harmless from any claims, damages, liabilities, and expenses arising from your violation of these Terms or your misuse of the website or services.

Governing law
